1. Introduction

These Terms and Conditions govern all photography services provided by Clive Westcott Photography (“the Photographer”). By booking any service, the Client agrees to be bound by these terms.

2. Booking & Payment

2.1 A booking is confirmed once a deposit has been received and written confirmation has been provided.

2.2 The deposit is non-refundable and secures the agreed date and time.

2.3 The remaining balance must be paid no later than the agreed deadline prior to the event or session.

2.4 Failure to pay the balance may result in cancellation of services.

3. Cancellation & Rescheduling

3.1 If the Client cancels the booking, the deposit remains non-refundable.

3.2 If cancellation occurs within 30 days of the event date, the full balance may still be payable.

3.3 Rescheduling requests will be accommodated where possible, subject to availability.

3.4 In the unlikely event the Photographer is unable to attend due to illness or emergency, a suitable replacement photographer may be arranged, or a full refund provided.

4. Coverage & Deliverables

4.1 The Photographer will provide services as agreed in writing prior to the event.

4.2 The number of final edited images delivered will vary depending on the type and duration of the event.

4.3 All images are professionally edited in the Photographer’s signature style. Raw (unedited) files are not supplied.

5. Image Delivery

5.1 Final images will be delivered via an online gallery or agreed digital format.

5.2 Delivery timescales will be discussed prior to booking and may vary depending on workload and season.

5.3 Clients are responsible for downloading and backing up their images upon delivery.

6. Copyright & Usage

6.1 Copyright of all images remains with Clive Westcott Photography.

6.2 Clients are granted a personal-use licence to print and share images for non-commercial purposes.

6.3 Images may not be altered, edited, or used for commercial purposes without written consent.

6.4 The Photographer reserves the right to use images for portfolio, website, social media, and marketing purposes unless the Client requests otherwise in writing before the event.

7. Client Responsibilities

7.1 Clients must ensure the Photographer has appropriate access to venues and locations.

7.2 It is the Client’s responsibility to obtain permission for photography at venues where required.

7.3 A safe working environment must be provided at all times.

8. Limitation of Liability

8.1 While every care is taken in capturing and processing images, the Photographer shall not be liable for circumstances beyond reasonable control, including but not limited to venue restrictions, weather conditions, or interference by guests.

8.2 In the unlikely event of equipment failure or data loss, liability is limited to the amount paid for the photography services.

9. Force Majeure

The Photographer shall not be liable for failure to perform obligations due to events beyond reasonable control, including natural disasters, government restrictions, illness, or venue cancellation.

10. Privacy & Data Protection

Client information is used solely for communication and service delivery purposes. Personal details will not be shared with third parties unless required by law.

11. Complaints

Any concerns regarding services provided must be raised in writing within 14 days of image delivery. Every effort will be made to resolve issues promptly and professionally.

12. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.
